Resolving family disputes outside of the Courtroom
Attending Court to resolve family disputes (e.g. divorce, financial settlements, childcare arrangements, etc.) can be a stressful, expensive and time-consuming journey for all involved. This is why the use of Alternative Dispute Resolution (ADR) is becoming more popular than ever before.
At Nelsons, our expert team of family law solicitors in Derby, Leicester and Nottingham provide a comprehensive and bespoke ADR service to our clients, utilising the specialist skills of our team.
-
What is family ADR?
Family ADR is a term summarising the variety of methods other than litigation that disputing parties can use to reach a resolution. ADR has several significant advantages that can make it more beneficial to parties than going through the Courts, such as:
- It’s quicker and more efficient;
- Less damaging to relationships; and
- Significantly more economical in terms of legal costs
ADR allows the parties involved to feel more in control of the process and it can also be less intense. If there are children, it puts their interests at the forefront.
-
What are the different types of family ADR?
If parties struggle to reach an agreement directly or through their solicitors, the family team at Nelsons can help them consider the following ADR options in an attempt to reach an out of Court resolution:
- Mediation
- Collaborative law
- Arbitration
- Private Financial Dispute Resolution (FDR)
