With the rapid growth of artificial intelligence (AI), it’s understandable that people are beginning to question the role of a traditional lawyer, particularly in areas like litigation. If AI can draft documents, analyse case law and offer basic legal information, do you really need a solicitor?
The short answer is: yes. And here’s why.
1. Legal expertise still matters – a lot
While AI can process large volumes of information and even offer suggestions based on legal precedent, it lacks one key ingredient: judgement.
Litigation is rarely black and white. Each case comes with its own nuances, strategy, risks and context. A good litigation solicitor draws on years of training and experience to weigh up legal options, anticipate arguments from the other side, and give strategic advice that reflects your individual circumstances. AI can assist, but it can’t replicate that insight or discretion.
2. Confidentiality and ethics are not optional
One of the biggest risks in relying on publicly available AI tools is how they handle your information. When you input details into a chatbot or automated service, how do you know where that data goes? Is it stored? Is it used to train the tool further? And could it be accessed or leaked?
Solicitors are bound by strict professional duties, including confidentiality and legal privilege. You can speak openly to your solicitor knowing that what you share stays between you and them. That’s not a guarantee any AI tool can offer.
3. Litigation is about more than just facts and law
The majority of legal disputes don’t end up in court – they’re resolved through alternative dispute resolution (ADR), such as mediation or negotiation. These are inherently human processes, requiring judgement, communication skills, and the ability to read the room.
AI can suggest what the law says. It can’t sense when the time is right to settle or when to push back. It won’t know when to apply pressure or take a more collaborative approach. Litigation lawyers do. And these decisions can often make or break a case.
4. You’re not just a case number
Legal disputes are rarely just about money or process. Often, they involve deeply personal or emotional matters – from business relationships breaking down to reputational issues or allegations that affect your livelihood.
A good solicitor doesn’t just handle the legal side – they’re a sounding board, a strategist, and, at times, a support system. You need someone who listens, who understands the bigger picture, and who can guide you with empathy and care. Artificial Intelligence can’t offer that. And it never will.
Using Artificial Intelligence well means knowing its limits
There’s no denying that AI has a place in the modern legal world. It can help streamline research, support document review, and save time on routine tasks.
The real value comes from combining technology with human expertise.
