Compensation for food poisoning
Cases of food poisoning are very unpleasant and cause a great deal of pain and discomfort. When you buy food from a restaurant or other food retailer, you trust that what you have been given is safe to eat. If they have caused you to be ill as a result of their negligence, you may be able to make a food poisoning claim for compensation.
Making a food poisoning claim
You can make a claim for food poisoning both in the UK and abroad but the laws relating to these type of claims are complex.
If you believe that you have suffered food poisoning it is important to visit your GP straight away, who will run tests to diagnose your illness. A confirmed diagnosis will help if you decide to pursue a food poisoning claim for compensation.
If a GP or hospital believes that food poisoning has occurred at a restaurant, they must report it to the local Environmental Health Department. If you do not go to a GP or hospital you should report the case to the local Environmental Health Department yourself.
The Environmental Health Department will then visit the food retailer and prepare a report. As well as hopefully preventing further occurrences, these reports can also be helpful as evidence in this type of case, and can assist in proving negligence and/or breach of statutory duty.
