Maternity negligence claims
Negligence during pregnancy, labour, or postnatal care that causes harm to the mother and/or their baby can lead to a potential claim. The different types of injuries that can be sustained include:
- Cerebral palsy
- Shoulder dystocia/Erbs’s palsy
- Stillbirth
- Neonatal injuries or death
- Organ damage
- Maternal death
- Damage to the mother’s pelvic area, bowel or bladder
- Third and fourth-degree perineal tears
These injuries or conditions could be because of:
- Failure to monitor – Negligent monitoring during pregnancy, labour, or delivery can lead to serious complications, including birth injuries and maternal harm.
- Poor neonatal care – For example, a failure to ensure the newborn baby is feeding adequately could lead to dehydration which in turn could lead to conditions such as hypoglycaemia, which could cause significant injury or worse.
- Misdiagnosis – Incorrectly diagnosing conditions such as preeclampsia, gestational diabetes, or fetal distress can result in delayed or inadequate treatment, putting both mother and baby at risk.
- Surgical errors – Mistakes made during caesarean sections or other surgical procedures can cause significant harm, including organ damage, infection, and excessive bleeding.
- Medication errors – Administering incorrect medications or dosage during pregnancy or labour can have harmful effects on both mother and baby.
If you think you or a loved one has suffered an injury due to negligent maternity care, it is vital to obtain legal support from a specialist solicitor as soon as possible.
