Funding A Medical Negligence Claim

If you have suffered an injury as a result of negligence by a doctor or hospital there are various ways in funding a medical negligence claim for compensation.

Types of funding available

  1. Conditional Fee Agreement (also known as a No-Win, No-Fee agreement)
  2. Legal Expenses Insurance
  3. Legal Aid
  4. Private Funding

Conditional Fee Agreement

Probably the most common way to fund your medical negligence claim. This agreement is also known as a No-Win, No-Fee agreement. The general principle is that if you lose the case your legal fees will be written off. If you win the case your legal fees will be paid by your opponent.

With this method of funding, at the end of any successful case a success fee and an insurance premium will be deducted from your compensation.

Legal Expenses Insurance

This type of insurance is usually found within your home insurance policy and may cover the costs of bringing a medical negligence claim. At Nelsons, we are happy to check any insurance policy on your behalf and are often able to act under the terms of your insurance policy.

Legal Aid

Before 2013 Legal Aid was widely available for medical negligence claims. However, following the implementation of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 legal aid is only available in cases where children are suffering severe disability through medical negligence causing a brain injury at birth to 8 weeks of life.

Private Funding

If the above methods of funding are unavailable, you can pay privately for us to investigate the initial stages of the claim. If we obtain supportive evidence, we may then be able to offer you a No-Win, No-Fee Agreement.
