Common Notorisation Request Of A Notary In Derby & Nottingham

We are often asked what requests we receive for notarisation (or, as the Americans say, notarization) in Derby and Nottingham.

The answer is ‘many and varied’ and they can involve matters and values from the small to the huge.

Common notorisation requests for individuals

For individuals, it can be as simple as evidence that the client is still alive – a ‘Life Certificate’ – which may be required by a pension payer (usually foreign). It can also involve producing notarised copies of the client’s passport or other identity documents, or Degree or other academic certificates.

Recently a client needed a Statutory Declaration evidencing how her name had changed from that on her Italian Birth Certificate. Powers of Attorney for use abroad need notarising and these can be used anywhere in the World. Often, in Derby and Nottingham, they are for use in connection with property in Spain, Portugal, Florida, or another holiday area or ‘notarization’ for use in USA. Family property in India, Pakistan, and the Far East usually gives rise to the need for a notarised Power of Attorney at some time.

Family affairs with foreign links, such as ‘Freedom to Marry Declarations’, Divorce and administration of Deceased Estates, will invariably require the production of notarised documents at some stage.

Notarisation of documents relating to sales and purchases of property in France is not an unusual requirement.

Over the years we have become familiar with documents which occur regularly, like the ‘Acte de Vente’ for France and the Poder (Poer of Attorney) for Spain.

The arrival of many from Hong Kong has increased the number of requests to do with documentation required there. Fortunately, China has now signed the Hague Convention and so accepts the Foreign Office ‘Apostille’ stamp to complete the legalisation of documents notarised for use there, rather than requiring consularisation by the Chinese Embassy, as it used to.

Common notorisation requests for companies

For companies, the demand has increased to match the increase in the amount of commerce being done abroad. In particular, Brexit has caused many companies to establish subsidiary companies in mainland Europe – something invariably requiring the production of a plethora of notarised documents.

Once involved in business overseas, companies often require notary services in connection with Companies House documents, employment contracts, business contracts, Board Minutes, etc. Sometimes the scale can be enormous. We have experience of being called on to notarise documents when multi-million dollar contracts could not be completed we had done so. On one occasion, airplanes were grounded until we had notarised documents enabling them to be cleared for take-off.
