If you have been involved in an accident with an uninsured or untraced driver, then you may be concerned that you are not able to claim for any personal injury that you have suffered as a result. However, there is some legal recourse through an organisation known as The Motor Insurers Bureau (MIB).
MIB
The MIB was established in 1946 to compensate victims of negligent uninsured and untraced drivers and it is estimated that the MIB helps around 25,000 people every year to make a claim. The organisation is funded by motor insurance companies; motor insurers are only allowed to operate if they belong to the MIB and share in its costs. This ultimately means that the MIB is funded by the general public and their insurance premiums.
Under the Untraced Driver’s Agreement, the MIB may also consider applications from “hit and run” victims where the driver’s details are not known.
Claiming through the MIB can be complex and there are strict time limits for notifying claims to the MIB. It is therefore advisable to engage a specialist personal injury lawyer on your side to take you through the process and act on your behalf.
Untraced road accident claims and uninsured road accident claims
The process begins by completing an MIB Claim Form and submitting it to the organisation. Your injury lawyer may take you through filling this form out and may also submit it on your behalf.
If the MIB agree to take on your case you would need to attend a medical examination either arranged by them or by your own solicitor. As a result of the examination the consultant will compile a medical report. This medical report forms the basis upon which your claim for your injuries will be valued.
The MIB not only deal with compensation for injury, but they may also deal with claims for losses and expenses as a result of an accident.
