Prosecution For Scalding Injury By HSE

A food manufacturer has been prosecuted by the Health & Safety Executive after an employee was scalded on the arm whilst cleaning machinery.

Whilst cleaning the cooking equipment, the victim was burned by hot cleaning solution after an outlet valve had been opened. If the risks had been correctly assessed before the cleaning procedure was undertaken, the accident could have been prevented.

The manufacturer had failed to comply with a number of regulations, including the Management of Health and Safety at Work Regulations 1999 and the Provision and Use of Work Equipment Regulations 1998. As such, they were fined £15,000 and ordered to pay costs of £8,950.20.

The victim is now in a stronger position to identify whether his employer was liable from a civil law perspective following the HSE’s prosecution.
