Making a food poisoning compensation claim
You can make a claim for food poisoning both in the UK and abroad but the laws relating to these types of claims are complex.
If you believe that you have suffered food poisoning it is important to visit your GP straight away, who will run tests to diagnose your illness. A confirmed diagnosis will help if you decide to pursue a food poisoning claim for compensation.
If a GP or hospital believes that food poisoning has occurred at a restaurant, they must report it to the local Environmental Health Department. If you do not go to a GP or hospital you should report the case to the local Environmental Health Department yourself.
The Environmental Health Department will then visit the food retailer and prepare a report. As well as hopefully preventing further occurrences, these reports can also be helpful as evidence in this type of case and can assist in proving negligence and/or breach of statutory duty.
