Health & Safety Reforms

The Government has published its report into reforms to health and safety law which have been implemented in the recent past.

They have aimed to simplify the law and make things easier and less burdensome for businesses. However, such concerns must obviously be weighed-up against the need to ensure ongoing protection for people who are at risk of injury.

According to Lord Freud, the Minister for Welfare Reform, the aim of the reforms was to ensure:

“…that health and safety regulation is sensible and proportionate… helping business to flourish whilst maintaining a healthy, productive workforce”.

One of the key changes relevant to personal injury claims is the removal of civil liability from breaches of a range of legislation known as “the six pack regulations”.

These regulations imposed specific duties on businesses in respect of their workers, breaches of which entitled injured people to claim compensation. This change does not mean that injured people cannot now claim compensation, but it does mean that it can be more difficult.
