If you’re going through a divorce and need help sorting out money, property, or pensions, you might be involved in a financial remedy case. The First Appointment is the first court hearing in this process. Here’s what you need to know:
-
What is the First Appointment for?
It’s not about deciding who gets what just yet. The First Appointment is mainly to:
- Make sure both sides have shared all their financial information.
- Identify what’s still needed (like valuations or expert advice).
- Set a plan for how the case will move forward.
-
What happens before the hearing?
Before the First Appointment:
- You and your ex-partner will exchange financial forms (called Form E).
- Your solicitor may prepare a short timeline and list of issues.
- Your solicitor may consider whether expert evidence is required – for example, a valuation of property, business interests, or pension reports.
- You’ll also say whether you’re ready to try and settle the case at the next hearing.
-
What happens at the hearing?
At the hearing:
- The judge checks that both sides have shared enough information.
- If anything is missing, the judge can order it to be provided.
- The judge may also suggest trying mediation or another way to settle without going to a full trial.
-
What happens next?
After the First Appointment:
- The court will set dates for the next steps, like getting property or pension valuations.
- The next hearing is usually a Financial Dispute Resolution (FDR) meeting, where you’ll try to reach an agreement.
In short:
The First Appointment is about getting organised. It helps the court and both sides understand what’s needed to move toward a fair financial settlement.
