Boy Injured by Dangerous Play Equipment

The manufacturers of a piece of play equipment have been prosecuted after a nine year old boy was injured after tangling his arm and finger in a net that formed part of the equipment.

The young boy was playing on a piece of play equipment at Rotherham’s Magna Science Adventure Centre when he was injured. He is not the first to suffer such injuries on this type of equipment, with similar injuries being recorded in 2008 and 2009.

Having admitted to contradicting health and safety legislation, the manufacturer was fined £75,000 plus £17,000 in costs. Furthermore, the victim may now be able to make a civil claim for compensation.

During the course of the prosecution against the manufacturers, it was brought to light that the equipment had a “real risk of entrapment” (even though alterations had been made). In spite of knowing about the danger the equipment posed, the manufacturer allegedly failed to warn users of these dangers, nor was the equipment revised.

Cases where accidents have been caused by play equipment can be complicated, however, Nelsons are experienced in dealing with such compensation claims. Following cases with successful prosecutions can also make it less complicated.
