Hit and Run Accidents

If you are injured in a hit and run accident that was not your fault then you will be able to claim compensation for your injuries and other losses.

The procedure is different if the driver is traced after the accident and depends on whether the driver was insured or uninsured at the time of the accident:-

  • If the Police succeed in tracing the driver who caused your hit and run accident and they had a valid insurance policy in force then we can can make your personal injury compensation claim as a normal claim to the driver's insurance company
  • If the driver is traced but did not have a valid insurance policy in force, we might be able to help you make a claim to the Motor Insurers Bureau (MIB) under the Uninsured Driver Scheme
  • If the driver is not traced then you may approach the MIB directly to see if they can help you

The Motor Insurers’ Bureau (MIB) deals with claims for innocent members of the public who have been injured or had their property damaged by an uninsured or untraced driver:-

  • You can deal with the Motor Insurers’ Bureau directly
  • However, the procedure may be a complicated and lengthy and we offer expert assistance with this

In making a claim for compensation resulting from any hit and run traffic accident it is important that you get accurate details about the accident - but this is especially important if the other driver has no insurance.

In most hit and run accidents you won't be able to get the driver's name and address but try to get these details if possible:

  • The model and registration number of the other vehicle
  • Details of the damage to your vehicle 
  • Photographs of the accident scene
  • Details of any witnesses to the accident

You should always ask for the other driver's Insurance details - if he or she has left the scene, or refuses to give you insurance details, you must report the incident to the police within 5 days.

  • You can only claim to the MIB once the police and your insurance company have tried to find the uninsured driver 
  • The MIB excess on all claims is £350
