Personal Injury Claim Settled Against Fast Food Restaurant

Ms. A suffered a personal injury resulting in her being taken to Accident & Emergency and undergoing surgery under general anaesthetic.

The incident occurred whilst she was visiting a KFC Restaurant in Derby to have lunch with her partner. Ms A purchased an original recipe meal which included two pieces of chicken with chips and a drink. As she started to eat the coating from one of the pieces of chicken, she realised that she’d swallowed a bone. Unfortunately the bone became stuck in her throat meaning she could not breathe properly and began choking and vomiting while her partner shouted for help. She had to be taken by ambulance to the Accident & Emergency Department of the Derbyshire Royal Infirmary.

X-rays confirmed a piece of bone was stuck in her throat. As a result Ms A required a general anaesthetic and surgery for removal of the bone; was kept in hospital overnight and the discomfort continued for some weeks after the operation. Fortunately she has now made a good recovery but clearly it was a very frightening incident.

The Personal Injury Compensation Claim was Successfully Settled 

Nelsons issued a letter of claim to the restaurant which was passed on to their insurers. Initially liability was disputed but after some further correspondence they admitted liability and following a medical report Helen Froggatt was able to successfully settle the claim for compensation on behalf of Ms. A.
