Mr H brought a claim on behalf of his late mother who had suffered a fall in hospital. Mrs H had dementia and was unsteady on her feet. She was already very frail and injured her lower back in the fall.
There was a failure to assess the risk of falls and a failure to respond when Mrs H pressed her buzzer as she needed help going to the toilet. She therefore tried to go on her own and had the fall causing the injury to her lower back.
Claire Liptrot and Baishali Majumdar represented Mr H in his claim, which was quickly settled for a four figure sum.
