After a paracetamol overdose which was ineffectively treated by the Accident and Emergency department, Nelsons represented Mr A in a clinical negligence claim against The NHS Hospital Trust.
Mr A had taken approximately 24 Paracetamol together with some Ibuprofen and Piriton. In the A & E department blood was taken for a Paracetamol level and the result was border-line for commencing treatment. However no treatment was given to Mr A and he was sent home.
Over the next couple of days Mr A became unwell and was admitted to hospital with life threatening liver failure. He spent a period of time in the Intensive Treatment Unit and was seriously ill for more than a week. He then made a reasonable recovery.
Nelsons obtained expert evidence that was critical of Mr A’s treatment in the A & E department. They were advised that with a background of alcohol abuse and uncertainty over the timing of the overdose, the borderline Paracetamol result should have lead to treatment with an antidote.
The Clinical Negligence Claim Was Settled
The Hospital Trust admitted liability and accepted that treatment with the antidote would have prevented the acute liver damage. Claire Liptrot and Baishali Majumdar were able to settle the claim for a five figure sum.
