Negligent removal of wrong tooth settles for £3,900

Nelsons represented Miss H in a claim against X Hospital Trust. Miss H was very nervous about dental treatment. When she needed teeth taking out, this had to be done in hospital under general anaesthetic or sedation.

Miss H had four teeth extracted but one of these was removed in error – the adjacent tooth should have been taken out. The wrongly removed tooth had been in reasonable condition.

Although the Trust failed to cooperate, the NHS Litigation Authority was prepared to negotiate a settlement without an admission of liability and the claim was settled by Claire Liptrot and Baishali Majumdar for a four figure sum.
