Breach of Duty Case Results in Five Figure Settlement for Hip Fracture

A patient submitted a Clinical Negligence Claim after he suffered a fractured hip from a fall, during his stay in hospital.

Nelsons represented Mrs P in a claim against Derby Hospitals NHS Foundation Trust. Mrs P’s husband had terminal cancer and normally walked with the help of a zimmer frame. One day whilst he was an in-patient the zimmer frame was left out of his reach despite a request for it to be moved to the side of his bed. The emergency call button was also out of reach and as a result Mr P stood up and fell fracturing his left hip which later required surgery

The Trust Admitted a Breach of Duty

Mr P’s condition deteriorated and he died 5 days after the fall.   Although he had terminal cancer his Consultant considered that the fall and surgery may have accelerated his death

The NHS Litigation Authority representing the Trust admitted a breach of duty causing Mr P to fracture his hip. Both parties accepted that the extent to which the fall contributed to or hastened Mr P’s death was uncertain and Claire Liptrot was able to settle the claim for a five figure sum.
