Food Poisoning

Cases of food poisoning are unfortunately very common, and you can make a claim for damages and losses as a result of food poisoning both in England and Wales and abroad if you had food poisoning on a package holiday.

Do you think you have a Food Poisoning claim?

Food poisoning is very unpleasant and causes a great deal of pain and discomfort for the sufferer.

When you buy food from a restaurant or other food retailer, you trust that what you have been given is safe to eat. If the restaurant or other food retailer has been negligent and caused you to be ill as a result of their negligence, you may have a claim.

The law on this issue is complex. Most food retailers have to be registered with their local authority, but certain retailers need to be approved as well.

Report your suspected case of food poisoning straight away

If you believe that you have suffered food poisoning from a food retailer it is important to visit your GP straight away. Your GP will then take some blood to confirm what infection you have. A confirmed diagnosis will assist should you decide to pursue a claim for compensation.

If a GP or hospital believes that food poisoning has occurred at a restaurant, they must report it to the local Environmental Health Department. If you do not go to a GP or hospital you should, in any case, report the case to the local Environmental Health Department yourself.

The Environmental Health Department will then visit the food retailer and prepare a report. As well as hopefully preventing further occurrences, these reports can also be helpful as evidence in this type of case, and can assist in proving negligence and/or breach of statutory duty.
