Claiming for Religious Discrimination

If you think you have been the victim of religious discrimination or belief discrimination then speak without obligation to one of our expert Discrimination Solicitors to see if you have a claim.

The Law protects any religion, religious belief or similar philosophical belief - there’s no complete list, but it includes all major religions.

The Employment Tribunal can decide what constitutes a religion or religious belief. You have the right:-

  • Not to be treated less favourably than someone else because of your religion or belief, your ‘perceived’ religion or belief, or the religion or belief of people you associate with - except if a religious belief is a necessary requirement for the job
  • Not to be disadvantaged by a policy at work because of your religion or belief
  • Not to be harassed or victimised because of your religion or belief
  • Not to be bullied or made fun of at work because of your religion or belief

How employers should accommodate your religious belief

Employers don’t have to provide time and facilities for religious observance (e.g. a prayer room) but they should try to do so where possible provided it doesn’t disrupt others or your ability to do your job properly:-

  • If you want time off for religious holidays, your employer should consider your request sympathetically – but they can refuse if it will affect the business
  • If you wear clothing or jewellery for religious reasons, your employer should make sure any dress code doesn’t discriminate against you

If you feel you’ve been discriminated against you can make a claim at an Employment Tribunal - please contact us to discuss how you should do this.
