It is unlawful for an employer to discriminate against you on racial grounds. For example:-

  • Colour
  • Nationality
  • Ethnic or national origins

It makes no difference if the discrimination is deliberate or not - all that matters is whether you were treated unfavourably because of your race. An exception might be when a particular racial or ethnic group is a genuine occupational requirement e.g. if a black actor is needed for a film.

Examples of Race Discrimination

Discrimination includes victimisation and harrassment and can be:-

  • Direct or indirect, deliberate or accidental
  • It applies to recruitment, terms and conditions, pay and benefits, status, training, promotion and transfers, selection for redundancy or dismissal
  • Offensive behaviour (e.g. racist remarks or gestures, using offensive nicknames related to race
  • Working practices or rules that promote discrimination
  • Unfair treatment if you have complained about discrimination
  • Failing to stop race discrimination by other employees

An employer can take positive action to provide support or encouragement to a particular racial group, but only where a specific racial group is badly under-represented in the workforce - but the employer can't discriminate when recruiting.
